ICC Seminar ‘Avoiding and solving disputes in the construction and engineering sector’

In 2016, approximately 20 percent of the cases before the ICC International Court of Arbitration were disputes from the construction and engineering sector. Why are there so many construction cases in ICC Arbitration and ADR? What is the nature of these conflicts?
Contracts in the construction and engineering sector regularly contain multi-tiered dispute resolution clauses, as is the case in the ICC model contracts and the FIDIC suite of contracts. These clauses aim to avoid disputes or to resolve them at an early stage. Disputes that are not settled through the preliminary tiers are often resolved through ICC Arbitration.
During this seminar, the nature of these disputes will be discussed. Secondly, this seminar will provide insight into the dispute avoidance and resolution mechanisms often adopted in the construction and engineering sector, particularly in light of the 2017 update of the FIDIC suite of contracts and the ICC model contracts. Attention will be given to the various preliminary tiers, including decisions of engineers, dispute boards and an amicable settlement period. The seminar will also provide insight into different perspectives on conflicts in construction and engineering projects.
